Assumption of Risk, Release of Liability and Indemnity Agreement
Please read carefully. This agreement affects your legal rights.
In exchange for being allowed to use the studio, equipment, classes and services of BeaHive Collective LLC ("BeaHive"), located at 2212 Main St, San Diego, CA 92113, I agree to the following:
1. I understand the risks
Sewing, cutting, pressing and related activities involve risks, including needle punctures, cuts from blades and shears, burns from irons and pressing equipment, pinching or crushing injuries from machines and presses, electrical hazards, trips and falls, repetitive strain, and injuries caused by other people. Industrial machines operate at high speed. I understand that BeaHive is often open without staff present.
2. I accept these risks
I choose to take part voluntarily and I accept all of these risks, known and unknown.
3. I will follow the rules
I will complete orientation, use only equipment I've been trained on, and follow the Studio Rules and Safety Policy. I will check each machine before using it and stop and report any unsafe condition or broken equipment. I understand that BeaHive staff may not be present to supervise me, and I am responsible for my own safe use of the studio.
4. Release
To the fullest extent allowed by law, I release BeaHive Collective LLC, its owners, instructors, staff and volunteers from any claims for injury, illness, death, property damage or loss related to my use of the studio, equipment or classes, including claims caused by their ordinary negligence. This release does not apply to gross negligence or willful misconduct.
5. Indemnity
I agree to cover BeaHive's costs if a claim is made because of my own actions or my guests' actions.
6. My belongings
BeaHive is not responsible for loss, theft or damage to my personal property, projects or materials, including items in storage.
7. Medical
I am physically able to take part. If I am injured, I allow BeaHive to call emergency services, and I am responsible for any medical costs.
8. Equipment damage
I am responsible for damage to equipment caused by my misuse or failure to follow instructions.
9. Photo and video
I understand that security cameras record in the studio. On the signed form, I choose yes or no to whether BeaHive Collective LLC may use photos or video of me and my work in the studio for marketing.
10. General
This agreement is governed by California law. If any part is found unenforceable, the rest still applies. It stays in effect for all my visits, classes and membership periods. An electronic signature counts the same as a signed paper copy.
I have read this agreement, I understand it, I've had the chance to ask questions, and I am signing it voluntarily. I understand I am giving up certain legal rights.
Signing
You'll sign this waiver in person at orientation, or before your first class. For participants under 18, a parent or legal guardian signs on the child's behalf and agrees to it for the child and themselves, gives permission for the child to take part, and allows BeaHive to get emergency medical care for the child if the parent can't be reached.
